This appeal is from an order and judgment which dismissed petitioner's writ of seeking a discharge from a commitment under ch. 975, Stats., the Wisconsin Sex Crimes Act and denied two motions by the petitioner made in conjunction with the writ. On February 24, 1971, petitioner was convicted of two counts of rape, contrary to sec. 944.01, Stats., and one count of theft, contrary to sec. 943.20(1) (a), (3) (d)2, Stats. Pursuant to sec. 975.01, Stats., the court ordered the Department of Health and Social Services to make a presentence social, physical, and mental examination of petitioner. The department concluded petitioner was in need of specialized treatment as a sex deviate, and pursuant to that recommendation, the trial court ordered petitioner committed to the department under sec. 975.06, Stats. On the theft conviction, petitioner was sentenced to an indeterminate term of not more than five years to be served concurrent with the commitment.
